Terms of Sale

DAMAGED OR LOST FREIGHT:
Both title, and risk damage or loss, pass to the buyer upon Parco, Inc. delivery of products to a carrier. All shipments should be carefully examined before their acceptance. Any damage or loss should be noted on the bill of lading at time of delivery, with the carrier being given immediate notice there of. Parco, Inc. will not be responsible for products damaged or lost in transit. The buyer
is solely responsible for providing carrier with timely notice of any damage or loss occurring in transit, and for pursuing all claims
against carriers for any such damage or loss.

SHIPPING CHARGES:
All Parco, Inc.'s products are shipped FOB Huntertown, Indiana. The Buyer is solely responsible for all freight charges. A 10% fee will be added to any freight charges which Parco, Inc. has been requested to “prepay and add” to its invoices. (The Buyer will be billed for all such charges and fees once Parco, Inc. has received a final billing from the carrier.)

ACCEPTANCE OF ORDERS/PRICES:
All orders are subject to prior credit approval, and to acceptance by Parco, Inc. at its office in Huntertown, Indiana. All prices are subject to change without notice, at any time prior to Parco, Inc.’s acceptance of an order.

CANCELLATION OF ORDER:
Cancellation of any order after its acceptance by Parco, Inc. will require Parco, Inc.’s approval. Since most Parco, Inc. products are manufactured to order, cancellation may entail a charge of up to 75% of Parco, Inc.’s invoice price (depending on the products involved, their stage of completion, and other circumstances).

PAYMENT:
All invoices are payable within 30 days of issuance; a service charge of 1.5% per month (18% per year) will be applied to all past-due accounts.

PARTIAL SHIPMENTS:
Partial shipments will be made only when requested. Those portions of orders shipped will be invoiced at the time of shipment; with the balance thereof being shipped, and invoiced, when available. Parco, Inc. reserves the right to ship on consecutive days, when doing so will result in lower freight charges.

LEAD TIMES/SHIPPING DATES:
Lead times and shipping dates (requested and/or quoted) are approximate only. While Parco, Inc. will attempt to meet all such production and shipment schedules, Parco, Inc. will not be liable for any delays incurred in the production, shipment, or ultimate delivery of its products, or for damages of any kind resulting there from.

LIMITED WARRANTY/ELECTION OF REMEDIES:
All products sold by Parco, Inc. are subject to the terms of a Limited Warranty against defects in materials and workmanship, which limit the Buyer’s remedies to the repair, or replacement of products determined to have been defective thereunder. The Buyer’s exclusive remedies for any such loss, damage, or expense associated with the purchase or use of Parco, Inc.’s products will be those set forth in such Limited Warranty. PARCO, INC. EXPRESSLY DISCLAIMS ANY AND ALL OTHER WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO THE EXPRESSED OR IMPLIED WARRANTIES AS TO THE MERCHANTABILITY OF ITS PRODUCTS OR THEIR FITNESS FOR A PARTICULAR PURPOSE OR USE.
Parco, Inc. warrants that the products it sells, or which are sold by its authorized representatives, distributors, or agents, will be free from defects in material and workmanship for a period of one (1) year from the date of their delivery to purchaser. Parco, Inc.’s obligation and purchaser’s remedy under this limited warranty are limited to the repair or replacement, at Parco, Inc.’s option, of products determined to have been defective within such period.
No person, firm, or corporation is authorized to alter or amend the limited warranty extended herein, or Parco, Inc.’s obligations hereunder. Parco, Inc. EXPRESSLY DISCLAIMS ANY AND ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO EXPRESSED OR IMPLIED WARRANTIES AS TO MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OR USE.

ELECTION OF REMEDIES/LIMITATION OF LIABILITY:
Purchaser’s exclusive remedies for products determined to be defective will be those set forth in the foregoing limited warranty. In no event will Parco, Inc. be liable for ordinary, incidental, or consequential damages or any kind arising out of the purchase, installation, or use of its products. In all events, the aggregate liability of Parco, Inc. to purchaser shall be limed to an amount equal to the purchase price of the product(s) upon which the liability is based.

Privacy Policy for Parco's Online Web Store Parco, Inc. utilizes ProStores, an eBay company, for our online store. The following is Parco's ProStores Privacy Policy and describes the types of information ProStores ("we" or "us") collects and how we use that information. Overview. This Privacy Policy is incorporated into and subject to the terms of the Parco ProStores Site Use Agreement. By accepting the Parco ProStores User Agreement and this Privacy Policy when registering to receive services from ProStores ("ProStores Services"), You expressly consent to our use and disclosure of Your personal information in the manner described in this Privacy Policy. If You choose to use Parco's ProStores Services, we may require You to provide contact and identity information, billing information, and other personal information as indicated on the Parco ProStores Site. Once You register on the Parco ProStores Site, You are no longer anonymous to us. We collect and store the following information: •Email address, physical contact information, and (depending on the service used) financial information; •Computer sign-on data, statistics on page views, traffic to and from Parco ProStores Site and ad data (all through cookies - You can take steps to disable cookies on Your browser, however this is likely to affect Your ability to use Parco ProStores Site); •Discussion board posts and other messages, including correspondence between Parco and You; and •General information regarding the Parco ProStores Services and Information You have registered to receive. Our Use of Your Information: We use Your personal information to: •provide Parco ProStores Services and products; •resolve disputes, calculate and collect fees, and troubleshoot problems; •verify users' identity and the information users provide; •encourage safe online experience and enforce our policies; •customize users' experience, analyze site usage, improve and measure interest in our services, and inform users about services and updates; •communicate administrative announcements when we need to provide users with information that may affect their use of ProStores Services and products; •communicate marketing and promotional offers to our users; •provide customer service; and •perform other business activities as described when we collect the information. Communications: During the course of the business, we may use Your personal information to deliver to You information that is targeted to Your interests. Upon receipt of the first communication of this type, You will have the opportunity to opt-out of future communications by clicking on unsubscribe link or by following unsubscribe instructions described within the communication. From time to time, we may implement solutions designed to more efficiently capture Your communications preferences. In any such event, we will strive to reflect any previously stated communicated preferences within such solutions. As part of your registration for Parco ProStores Services on the Site, You agree that You may receive certain administrative communications from Parco ProStores, such as administrative announcements and customer service messages regarding Parco ProStores Services and products, and You will not be able to opt out of receiving such administrative communications. Our Disclosure of Your Information. We do not sell or rent Your personal information to third parties for their marketing purposes without Your explicit consent. We may disclose personal information to respond to legal requirements, enforce our policies, respond to claims that a listing or other content violates other's rights, or protect anyone's rights, property, or safety. We may also share personal information with: •corporate affiliates to help coordinate the services we provide to You, enforce our terms and conditions, and promote trust and safety; •service providers who help with our business operations and assist in the delivery of Parco ProStores Services to our users. •law enforcement or other government officials in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of Merchant User Agreement, or as otherwise required by law; and •If we or our corporate affiliates are involved in a merger or acquisition, we may share personal information with another company, but this Privacy Policy will continue to apply unless it is amended as described in "Notification of Changes" section set forth below. •We delete personal information when we no longer need it for the purposes we described earlier. We retain personal information as permitted by law to resolve disputes and enforce our policies. Security. To prevent unauthorized access, promote data security, and encourage appropriate use of information, we use a variety of tools (encryption technologies, passwords, physical and electronic security, procedural safeguards) to assist in the protection of Your information. However, "perfect security" does not exist on the Internet, so we make no guarantees. Notification of Changes. We may amend this Privacy Policy at any time by posting the amended terms on the Parco ProStores Site. site. In the event of amendment, all terms shall become effective 30 days after they are initially posted to the Parco ProStores Site. Your continued use of Parco ProStores Services, systems, and network will constitute your acceptance of any changes or additions to this Privacy Policy.
